TERMS AND CONDITIONS
myjoolsbyilana Jewelry is a website that sells gold jewelry (hereinafter "the Products"). The Products are offered to the public via the Internet, in Israel and around the world, through secure sales on the website.
The website serves as a virtual store for the sale of jewelry and is owned and managed by Gayag Ltd. (hereinafter "the Company").
These terms and conditions shall apply to any use and purchase made by the customer (hereinafter "the Customer") on the website and shall constitute the legal basis for orders on and browsing of the website. They shall be the sole terms and conditions that regulate the relationship between the Company and website browsers and/or people ordering via the website. The Customer is requested to carefully read these terms and conditions in full.
Any person who places an order and/or makes a purchase through the website declares that, in executing the transaction, they have read these terms and conditions. Browsing the website and/or purchasing a Product offered for sale on the website constitutes the Customer's agreement to accept and act in accordance with all the provisions of these terms and conditions, and that neither they nor their assignee/s shall have any claim and/or demand and/or suit against the website and/or the Company and/or any of its managers and/or employees, in any matter relating to the provisions of these terms and conditions.
Only what is registered on the Company's computer regarding the actions taken through the website shall be prima facie evidence of the correctness of the actions.
The terms of use of the website apply to the use of the website and its services by any computer or other communications device (such as cellular phones, handheld PCs etc.) and also apply to the use of the website, whether via the Internet or through any other network or mode of communication.
The Company reserves the right to change these terms and conditions from time to time at its sole discretion, without being required to give any warning and/or prior notice.
Rules of using the website
Any user who fulfills the cumulative conditions listed below may participate in the sale process: any person over the age of 18, holding a valid credit card of one of the credit card companies operating in Israel.
Completion of the transaction on the website is conditional on the following conditions being met:
- the ordered Products are available and listed in stock at the time of the order
- the order details have been completed correctly and in full for the purposes of billing and delivery on behalf of the Customer
- approval has been granted for the transaction to be executed by the credit card company.
Notwithstanding the above, the Company may refuse to allow a particular customer to purchase Products on the myjoolsbyilana website for any reason whatsoever and even if they have in the past ordered Products through the myjoolsbyilana shop and/or the website.
Without limiting the above provisions, the Company may cancel a Customer’s right to execute transactions on the myjoolsbyilana website in any of the following cases:
- if the Customer has acted contrary to these terms and conditions
- if when registering on the website the Customer provided incorrect information, committed any act or omission that harms or may cause harm to the website or any other legal entity connected to it or any third parties, including the Company’s customers and suppliers
- if the Customer used the services of the website to perform an act that is illegal according to the laws of the State of Israel, or to enable, facilitate, assist or encourage the performance of such an act
- if the Customer has breached the terms of this agreement or the terms of any other online service offered by the Company
- if the credit card used has been blocked or restricted for use in any way
- if money is owed to the Company or any of its affiliated companies and the debt has not been paid, even though the payment date has passed.
Good faith
The Company and/or the suppliers shall not be bound by any fundamental error occurring in the description of any Product, price or other material detail.
By law, Product prices include VAT.
Products are delivered to Customers through a courier company.
Product delivery times
Courier deliveries will be coordinated in advance, prior to delivery of the Product. The Company undertakes to package and send out orders for delivery to the requested destination within three days, that is two days after order confirmation, so long as the Product is indeed in stock. Since our Products are handmade and must undergo quality control, for goods not in stock the delivery time will be 21 business days from receipt of the order confirmation. If a number of items are ordered, the shipment will be delivered to the Customer on receipt of all the Products, unless the Customer chooses otherwise, since delivery costs will be payable for each separate delivery.
Orders will be sent via a courier company that delivers to most parts of the country within seven business days.
Returns and exchange of goods
myjoolsbyilana jewelry may be returned or exchanged. If the Customer chooses to exchange the Product at the Company’s store, they must comply with these terms and conditions, and produce a purchase receipt. Returns and exchanges may be carried out within 7 business days of the date of purchase, and only if the Product is in its original packaging. Any Product that has been used or damaged will be returned to sender and will not be replaced. The Customer must attach to the Product the "Sorry but it’s not for me" card which comes with the order. The Customer must make sure to include in the package their full name, address and the reason for returning the Product. They will receive confirmation by e-mail and will then receive the price paid for it, with delivery and insurance costs payable at the Customer's expense and being under their responsibility. myjoolsbyilana does not refund delivery expenses, unless the Product is being returned due to a mistake by the Company. Products bought at a discounted price will not be refunded.
The website’s management may offer promotions, benefits and discounts on the website. The website's management may at any time discontinue, replace or modify such promotions, benefits and discounts, without prior notice.
The Company is not obliged to maintain inventory of all models and/or Products whose images appear on the website.
The Company does its best to ensure that the information presented on the website is the most complete and accurate information available, but it is hereby clarified that inaccuracies or errors may appear in good faith, and the Company shall not bear any liability arising from or related thereto.
The website’s management is entitled from time to time to update Product prices and delivery rates on the website, without prior notice. The valid price relative to an order is the price published at the time the order process is completed - the Customer will be charged the most up-to-date price.
A delay in the delivery date, for any reason, will not give rise to any right to receive any compensation and/or funds other than the right to cancel the transaction, in accordance with the terms of this agreement.
Data protection and privacy on the website
The Company prevents unauthorized access to our databases, keep all information up-to-date and ensure proper data usage. The Company is aware of the sensitivity involved in operating an online sales website, and takes advanced precautions to ensure a secure purchasing process.
The process of purchasing a Product through the website
In order to make a Product purchase, a registered Customer is required to fill out the order form on the website. For the purposes of clarification, filling in all details of the form is a prerequisite for executing the order.
Upon completion of the transaction and its approval by the credit card company, the Customer will receive a notice confirming that the transaction has been executed, together with a tracking number. This confirmation will be sent to the email address provided by the Customer during the ordering process.
This confirmation does not obligate the website’s management to supply the Products - it only indicates that the details of the order have been received.
In the event that the transaction is not approved by the credit card company, the Customer will receive an appropriate notice and will be asked to provide another payment method.
Approval of the purchase is conditional on the Product being in stock at the Company's warehouse on the requested delivery date and/or at the time of the order. But even if it is not stated that the Product is not in stock and even if the Product has not been removed from the website before the date the order is made, the Company will not be obligated to sell the Product, and the Customer will not have any claim or suit in the matter for any type of damages, whether direct or indirect, whether to themselves or to a third party. The aforesaid is subject to the fact that the website's management will refund any amount paid by the Customer, if they have indeed paid the Company, and/or the Company will cancel any charge made in relation to the purchase. It should be emphasized and clarified that there may be situations in which even if a specific item is presented on the website as existing in inventory, it is in fact not in stock and cannot be supplied - in these situations the transaction will be canceled and the Customer will have no claim in this regard, other than a refund of the amount paid to the Company by the Customer.
According to the rules of the website, the receipt of a gift in the context of a promotion is limited to one item per customer.
Clarification: providing incorrect personal details is a criminal offense and it is the responsibility of the Customer to fill out their exact details when placing orders for any of purchase.
Prices
All prices listed on the website are quoted in US Dollars. Where the law requires a Product to be subject to VAT, the price includes VAT at the applicable rate according to the current law of the State of Israel. Prices do not include delivery charges.
Cancelation of an offer or transaction
Insofar as, subject to and in accordance with the provisions of the Consumer Protection Law, 5741-1981 (hereinafter “the Law”) and the provisions below regarding how to return products, the Customer is entitled to cancel the transaction:
- cancellation of a transaction will be allowed up to 14 days from receipt of the Product, in its original packaging with the label of the Product attached to the tag
- it is agreed by the parties that the Customer will be charged in full for the cost of delivery, even if they have not received the Product, if the Product that is the subject of the transaction has already been sent
- any credit will be transferred only to the credit card with which the order was made, according to the timetable of the credit card company
- It is further clarified that no monetary credit will be given for Products for which no monetary consideration has been paid, such as promotions or gifts.
How to return Products
If the Customer wishes to return the Product by mail, the Customer will send the Product back by registered post to: Lara Rosnovsky, 40B Gordon St. 43354, Raanana, Israel. Upon receipt of the Product, the delivery charge will be refunded to the Customer. Alternatively, the Customer may ask the website’s management and/or the supplier to send a courier to their home to collect the Product and return it, at the Customer’s own expense.
The Company cannot take responsibility for delays of the various delivery companies, but will be available to solve any problem.
It is agreed that the return and/or replacement of Products (within 30 days of receipt of the said Product) will only be possible if the Product is not used and is kept in the condition it was in at the time it was received.
Any cancellation of a transaction will automatically cancel any benefit and/or right and/or gift received by the Customer as part of the transaction and/or as a consequence thereof. The Customer shall return any such benefit immediately upon cancellation of the transaction and/or return of the Product.
Returns and replacement of myjoolsbyilana jewelry can be made at the store at 28 Ussishkin Street in Ramat Hasharon.
In accordance with the provisions of the Consumer Protection Law, the provisions detailed above do not detract from the right of the website owner to sue the Customer for damages where the value of the Product has decreased as a result of deterioration in its condition and/or packaging that was caused after it was delivered to the Customer, even where the transaction is cancelled due to a defect and/or malfunction and/or unsuitability of the Product.
Responsibility of the Company
myjoolsbyilana undertakes to act fairly and to provide a high standard of service.
The Company does not undertake to keep stock of all models and/or jewelry whose images appear on the website.
The Company does everything in its power to ensure that the information presented on the website is the most complete and accurate information, but it is hereby clarified that inaccuracies or errors may appear in good faith and the Company shall not bear any liability arising from or related thereto.
Neither the Company nor anyone acting on its behalf shall be responsible or liable for any direct, indirect, consequential or special damages caused to the user or browser or Customer or any third party as a result of any use of or purchase through the website that is not in accordance with these terms and conditions, whatever the cause of the action - including loss of income and/or loss of profits - caused by any reason, in which case the Company reserves the right to cancel the order in question.
The images of Products on the website are intended to be for illustration only and there may be differences between some or all of the images displayed on the website and the Products that are actually sold.
In no event shall the Company bear any liability in excess of the value of the jewelry and/or the Product purchased, nor any indirect damage and/or consequential damage.
The Company does not store credit card numbers on its computers.
myjoolsbyilana uses the highest security standards in order to maintain the confidentiality of information and privacy of its customers. The Company uses PayPlus, the leading credit card clearing and security company in Israel, for the purpose of checking and securing information.
Intellectual property
The copyright and intellectual property rights on the website belong solely to myjoolsbyilana, or to those third parties who have granted the Company permission to use them. The Company owns the rights to use and/or distribute the names and trademarks of the website and the software, the marketing content of the website and the software, whether registered or unregistered, the trade secrets involved in the operation of the website and the software, and in the provision of services, the design of the website, the information technology involved in its operation, including software, applications, graphic and other files, computer codes, texts and/or any other material contained therein.
It is forbidden to copy, reproduce, distribute, sell, market or translate any information from the website, including trademarks, images and texts, jewelry design, photographs of the jewelry, etc. without the prior written permission of the Company.
It is forbidden to make any commercial use of the data published in the database, the list of Products appearing in it, or any other details published therein, including graphics, design, verbal representation, logos or special offers, without the prior written agreement of the website’s management.
The website services must be used for lawful purposes only.
It is forbidden to use any data published for the purposes of presentation on the website or any other service, without the prior written agreement of the website's management, and subject to the terms of such consent (if given).
Terms of payment
The Company accepts payment via leading credit card companies such as Visa, Mastercard and Isracard, and works with PayPlus to keep the Customer’s payment information secure.
